Xceligent – Data Breach Class Action

The Claims

Plaintiff filed a class action on behalf of 543 Xceligent employees whose W-2 information was disseminated to a hacker. This involved a phishing attack in which the hacker used an email address manipulated to appear as if the CEO was requesting W-2 forms from an employee in human resources. 

The Result

After more than two years of litigation, the court approved a settlement valued at approximately $1,642,600.00 to the class. It included cash payments to each employee of $1,000.00, reimbursement for up to $1,200.00 more for out-of-pocket expenses, and receipt of three years of premium identity theft and credit monitoring protection.
